The NBA legend Testifies He ‘Wasn’t Afraid’ of Nascar in Antitrust Trial

The basketball icon, as he cordially introduced himself in a federal courtroom on Friday, stated that his competitive side and status as a newcomer emboldened his effort with 23XI Racing to “challenge” Nascar over alleged violations of competition laws.

Team Investment and a Will to Win

The owner disclosed financial and corporate details of his 23XI team, saying he invested $40 million of his personal wealth into the Cup Series operation launched with partner Polk and longtime driver Denny Hamlin.

“Someone had to step forward,” Jordan said in the Charlotte courtroom. “I was a new person, I had no fear. I felt I could challenge Nascar in its entirety. From my perspective, the sport it needed to be looked at from a different view.”

The Core Dispute: Charter Agreements and Renewal Demands

At issue is the end of a 2016 deal where Nascar granted each team a franchise. This system mirrors other professional sports with independent franchises, like the Charlotte Hornets or the Carolina Panthers. The agreement was due to end in 2024 when Nascar demanded teams renew their charters.

Jordan testified for about sixty minutes and left the court to a media frenzy, with fans and media clamoring for a view or a photo of the sports legend.

Leading the Legal Charge

23XI Racing is leading the full-court press along with Front Row Motorsports for Nascar to overhaul a operating model Jordan contended is breaking the law to maintain excessive control.

For Jordan and and a fellow team representative, who testified before Jordan, are events from September 2024. Gibbs described a frantic and emotional period where the sanctioning body informed teams they must sign a contract extension. This agreement spanned 112 pages outlining pay for chartered teams and a guaranteed entry in every race.

Choosing Litigation

Jordan said that 23XI and Front Row Motorsports decided their only feasible option was to refuse a signature that extensive document and litigate the matter. All other teams signed the agreement.

Jordan and co-owner Denny Hamlin approached Nascar about potential amendments or extension options. Nascar wasn’t talking, Jordan said.

The Ultimate Motivation: Winning

But in the end, the pushback against what he saw as a financially unsustainable model was driven by the familiar goal for Jordan: Success.

“Denny convinced me adding a third car improved our chances to win,” he testified, sharing that he bought a third charter late in 2024 for $28 million amid the legal dispute. “So I dove in.”

Heather Gibbs detailed her request for permanent charters, which she said a formal letter to Nascar. She testified the timing of the signature deadline was problematic.

According to her, the team founder first tried to call and talk Nascar out of forcing signatures, but Nascar’s leader refused the appeal.

“Please don’t force this on us,” Gibbs recounted was the message to Nascar’s executives. She said France replied, “Whether I have 20 charters, that’s what I have. If there are 30, I have 30.”
